, A case alleging that student loan giant Sallie Mae inappropriately made automatic telephone dialing system calls (aka robocalls) to the cell phones of people who were behind in their payments.
Now, we realize that Congress did pass the Telephone Consumer Protection Act, which does limit calls to customers' cell phones. But let's connect the dots...because they lead to yet another jackpot for the lawyers.
Last February, a lawyer named Mark A. Arthur of Seattle filed suit against Sallie Mae . According to the Puget Sound Business Journal , Sallie Mae "harassed" him with "unrelenting" calls to his cell phone after he fell behind in his Seattle University School of Law loan payments. He asked for $500 per call that violated the federal law.
On June 23, the parties reached a settlement that was the "product of days of mediation, meetings and negotiations," according to the settlement agreement.
So what do delinquent student loan borrowers get? The promise that Sallie Mae won't robocall their cell phones anymore - if and only if the borrower provides a land line number on which they can still make the automated calls. If the borrower is like many, perhaps a majority, of people in their 20s and doesn't have a land line, only a cell phone, the calls can continue. Oh, and the borrower has to send a form back to Sallie Mae to stop the calls.
